A Superior Court judge ruled that the city of San Diego owns the land that the failed Mercado project in Barrio Logan sits upon.
The shopping center project was part of the redevelopment area in that waterfront neighborhood, but it was never launched. The City Council, acting as the Redevelopment Agency, voted to take back the land in 2006 after allowing the Mercado Alliance to develop it three years earlier.
The court also denied the developer’s claims for damages, but has not yet ruled on the city’s argument that the firm breached its contract.
