City Attorney Mike Aguirre sued Kinder Morgan Energy Partners today seeking the damages related to a polluting fuel plume near Qualcomm Stadium.

The plume — caused by thousands of leaking gallons of petroleum from a nearby tank farm owned by Kinder Morgan — has seeped under the 166-acre city-owned stadium property.

Though it was originally targeted for clean up in 1992, the plume has not been removed. The cost of cleanup has been estimated at $26 million.

“Defendants took decades to make this mess, and have had decades to clean it up,” the lawsuit states. “Enough is enough. The time is now for Defendants to take care of this problem.”
