A spokeswoman for Council President Scott Peters said today that the City Council will revote on whether to send a “friend of the court” brief to the state Supreme Court in support of legalizing same-sex marriage.

The council fell one vote short of approving the proposal yesterday. Peters and Council members Toni Atkins, Jim Madaffer and Ben Hueso voted to send the brief. Council members Kevin Faulconer, Tony Young, Brian Maienschein and Donna Frye voted no.

Frye could be the swing vote on the issue. She said she voted against the proposal she felt there was not enough time for the public to react to it, but implied that she was sympathetic to the motivations behind filing the brief.

The revote is scheduled for Sept. 18.
