The City Council will revote on a proposal to write a “friend of the court” brief supporting same-sex marriage on Tuesday.

The idea fell one vote short Sept. 4, but it is expected to pass after Councilwoman Donna Frye said she would vote yes after initially opposing it. Frye said she voted no earlier because the public didn’t have enough time to review the issue and give input.

Under the proposal, the city of San Diego would join other cities across California in contacting the state Supreme Court, which is hearing a lawsuit seeking to make same-sex marriage legal.

On Sept. 4, Council President Scott Peters and Council members Toni Atkins, Jim Madaffer and Ben Hueso supported the proposal. Frye and Council members Kevin Faulconer, Tony Young and Brian Maienschein voted against it.
