Mayor Jerry Sanders is undecided whether to support a legal brief advocating same-sex marriage that the City Council may send to the state Supreme Court.

“He is still weighing his options,” spokesman Bill Harris said.

Today, the City Council will likely support the “friend of the court” letter that Councilwoman Toni Atkins wants to send to the state’s high court in support of a lawsuit seeking the legalization of same-sex marriage. The proposal fell one vote short earlier this month, but Councilwoman Donna Frye said she will support it after voting against it.

I have a call into the City Attorney’s Office to figure out the mayor’s ability to participate in the legal brief. Under the current strong-mayor form of government, Sanders does not vote with the council on legislation such as the resolution Atkins is proposing, but he could have a role in signing or vetoing it.
