San Diego Unified School District has no legal basis to remove trustee Luis Acle in the wake of his Ethics Commission fine, an attorney counseled the school board in closed session today.

Jose Gonzales, the district’s legal counsel, told the board that “the present circumstances related to board member Acle” do not justify removing the trustee. No relevant policies exist at the school district, he said, and the City Charter that outlines how trustees are elected “does not speak to removal of board members.”

Gonzales was requested to advise the board on that issue by one or more board members, he said. He reported his findings in an open meeting following the closed session.
