The Union-Tribune is reporting that a local judge has tentatively ruled that Sunroad Enterprises has no legal basis for recovering money lost when San Diego city officials ordered it to tear down the top of its controversial tower.

Superior Court Judge Timothy Taylor said he plans to throw out the $40 million lawsuit filed over a tower that federal regulators say was a flight hazard because of its proximity to the Montgomery Field municipal airport.
