A judge is considering allowing home detention or a stay in a halfway house for an ex-San Diego Police Department officer who failed to pay taxes on his salary and profits he made by selling stolen goods on E-Bay, the North County Times reported today.

James Estrella was to be sentenced this morning, the story says, but U.S. District Judge Roger Benitez said he wants six weeks to think about the defense proposal. Prosecutors have recommended 15 months custody for Estrella.

The judge has given Estrella six weeks to prove that he is employed and receiving an income.
