In this letter yesterday, Council President Scott Peters assured the retirement system’s administrator that his actuarial consultant, Gene Kalwarski, wouldn’t be subject to questioning from City Attorney Mike Aguirre or his deputies. The administrator, David Wescoe, had expressed concerns that such questioning would be problematic because of the ongoing legal battle between Aguirre and the pension system.

The city attorney fired back today with this letter to Peters in which he said the council president had no authority to prohibit Aguirre from questing individuals at City Council hearings.

From the letter:

In no event is the ongoing litigation between SDCERS and the City a shield behind which SDCERS can hide to avoid appearing before the Council or answering questions from the City Attorney. Please inform Mr. Wesco that his appearance before the Council shall be unconditional.
