There’s a fork in the road leading to City Attorney Mike Aguirre’s pension underfunding argument, and his path to pension rollbacks now appears obscured by pesky legal conclusions that he previously issued. Apparently San Diego’s city attorney is between the proverbial rock and a hard place; he must either support his previous reports and risk losing a mega-lawsuit ($175 million), or reject the validity of those reports and jeopardize the city’s position in the pension benefits lawsuit.

Either way, Mr. Aguirre’s self-created conflict will result in the city forking out big bucks. He can’t have his cake and eat it too. Both Superior Court Judge Strauss and Mr. Conger have grown weary of his stalling tactics and now want straight answers from our city attorney. And straight answers are difficult to get from someone who speaks with a forked tongue.
